This is a typical he-said she-said blame tactic where the driver tries to blame the cyclist for running a stop sign or a light, when in fact the driver was the one who ran the stop sign or light. This situation is best overcome by independent witnesses who saw the collision and can tell exactly who blew the stop sign or light, or failed to yield, and how. The traffic collision report may have adopted the driver’s story only, and none of the independent witnesses’.
Don’t ever assume that the police will include the contact info of independent witnesses in the report just because you saw the police officer talk to the independent witness. Always ask for contact info of witnesses yourself, or have someone at the scene ask them for you if you are not in a physical or mental condition to do so because of your injuries. A good witness is worth a thousand words, literally.*
